Order below CS No. 1314/14 -
Perused the CS which is supported by an affidavit being executed by Ajay Puranik.  Also perused the affidavit in reply being executed by Shourya Himatsingka.  Also perused the affidavit in rejoinder of pltff.  Heard ld. Adv Dalal and Adv Akash.  The main suit is for declaration regarding the removal notice dt. 28/01/2014 and 26/03/2014.  It is and admitted fact that till this date none of the defts have filed their WS.  I have perused the proposed amendment which is annexed as scheduled (a) to the CS.  On perusal of the proposed amendment it is not going to change the nature of the suit, percontra considering the subsequent events which are in connection with the subject matter of the suit those amendments are necessary to be incorporated for proper adjudication of the dispute.  The affidavit in support of CS shows that justified reasons are mentioned for not incorporating those facts at the time of instituion of suit.  Hence as per the provisions of Order-6, Rule 17 of the CPC the proposed amendment is necessary to be brought on record and therefore I pass the following order-
ORDER
1. CS No. 1314/14 is allowed and made absolute in terms of prayer clause (a)
2.  Pltff to carry out the amendment within 2 weeks.
3. Personal appearance of parties to carry out the amendment is dispensed with.
4. Pltff to supply the copy of the amended plaint to the deft within 2 weeks after amendment is carried out.
