The submissions made at bar by Adv. Mr. Giri for BMC in consultation with the officer that they will consider the application for plaintiff for monsoon shed in view of the circular issued by the BMC dtd. 5.6.2018. It is further submitted that since defendant is going to consider the application as per the circular then there is no need to keep the present matter pending.
He prayed for the dispose of the suit. The Ld. advocate of plaintiff consented as the same. Therefore, the present suit stands disposed of. In view of the prayer made by the plaintiff till the application of plaintiff is under consideration the defendant/BMC not to take any coercive action against the plaintiff . If the application/ representation made by the plaintiff is adverse then defendant/ BMC not to initiate any coercive action from the date of service of adverse order passed if any. Since suit is disposed off the draft N/M stands disposed off. The N/M be registered for statistical purpose.
