Heard arguments of both the sides on chamber summons. Perused chamber summons, supporting affidavit and affidavit in reply filed by the respondents. The chamber summons is taken out to bring on record the legal heirs of deceased defendant. The copy of death certificate annexed with the supporting affidavit shows that defendant died on 16.08.2020. It is the case of the plaintiff that adv for defendant informed about the legal heirs by letter dated 30.01.2021. The draft chamber summons is tendered on 06.02.2021. The suit is for recovery of money. Cause of action survives against the legal heirs of deceased defendant. The plaintiff is entitled to the extended period of limitation as per the judgment of the Hon\\\''ble Supreme Court in suo moto Writ Petition civil No. 03/2020 whereby limitation period till 28.02.2022 is extended in the backdrop of pandemic situation. Therefore, chamber summons deserves to be allowed. In the result, following order is passed.

1. Chamber Summons No. 286 of 2021 is made absolute in terms prayer clause (a), (b) and (c).
2. Plaintiff to carry out amendment within 14 days and shall submit copy of amended plaint on record and also serve the same upon respondents.
