Order Below Exhibit 9:
1. Perused the application and record. Also gone through
the pleading of NM No. 2217 of 2018, whereby, the plaintiff sought
for setting aside of the Notice dtd 20.08.2010 and the Order dtd of
03.05.2011. Certainly, such relief can’t be considered at this stage
of the matter, simply because it would need the trial on its merits.
Hence, leaving the plaintiff at liberty to ask for such prayer on later
stage of this suit, if he is not otherwise prevented by law, NM No.
2217 of 2018 is disposed of. Accordingly, the application at Exhibit
9 is also disposed of. The parties to note.
Earlier Order, if any, is continued till the next date.
