no.6 is the developer who is developing property of
Defendant no.5 Society, hence Defendant no.5 and 6 are
formal parties to the suit who will have to behave as per the
consent terms Exh.7. Plaintiff and Defendant no.1 and 3 are
directed to sign the consent terms today before the Court.
Accordingly, they have signed consent terms in presence of
the Court. Plaintiff and Defendant no.1 and 3 have admitted
contents of consent terms Exh.7 are true and correct, hence,
consent terms are verified. Further, Plaintiff has also filed
withdrawal pursis at Exh.8 for withdrawing the suit against
Defendant no.2 and 4. ORDER BELOW EXH.1 1. In view
of withdrawal pursis Exh.8, suit stands disposed off as
withdrawn against Defendant no.2 and 4. 2. In view of
consent terms Exh.7, suit stands decreed in terms of Consent
terms Exh.7 against Defendant no.1,3, 5 and 6. 3. Decree be
drawn up accordingly. 4. Issue C. F. refund certificate as per
rules in the name of plaintiff. 5. Notice of Motion
no.3853/18 and 2216/18 stands disposed off accordingly.
