Read the application . Heard to the ld. Advocate for plaintiff, who has submitted that the advocate for defendant filed the pursis before the ld. Magistrate Court at Girgaon on 17/07/2018, contending therein that defendant is currently residing in the disputed house and has pointed out that as per the reply to the Notice of motion no.2262/2018 , the defendant has contended that she has executed registered agreement for sale dated 19/06/2018 in respect of the said flat. It is submitted that there is urgency in the matter, otherwise defendant will handover the possession of the said flat to the prospective purchaes therefore, it is requested to preponding the date for hearing on N/M.
On the otherhand the ld. Adv. appearing for defendant has submitted that on 28/04/2018 stamp duty is paid and it is requested not to prepond the date. Considering the urgency in the matter that the defendant is going to handover the possession to the purchaser, the interest of justice requires to prepond the date for early hearing on N/M. Hence the date is prepond and it is kept for hearing on 07/08/2018 for hearing on N/M no.2214/2018 as well as 2262/18.
