From the speaking order dtd 02.06.2018 it is observed that the said order is passed on the basis of document submitted by the plaintiff on 21.03.2018. As per the roznama dtd 04.04.2018 Court directed the defendant/BMC to consider the reply filed the plaintiff dtd 21.03.2018 and also granted permission to plaintiff to submit additional documents within 7 days from 04.04.2018. From the order dtd 02.06.2018 it is observed that without giving opportunity to the plaintiffs and without considering the documents filed by the plaintiff after 04.04.2018 as per the directions of the Court the defendant arbitrary passed the order. Thereby violates the directions of the Court.
Directions given to defendant once again give the hearing the plaintiff and consider the documents filed by the plaintiff after 04.04.2018 and passed the order on merits within the 15 days from today. And further 15 days time be given to the plaintiff in case any speaking order is passed against the plaintiff.
