Advocate for the plaintiff has requested to extend ad-interim relief. However, the roznama shows that ad-interim relief is not in existence. So, the question of extension of the ad-interim injunction does not arise. Advocate for plaintiff may argue the NM on merits.
The ld. advocate was asked to argue the notice of motion on merits. However, instead  of arguing the matter of merits, he was making irrelevant submissions which were not germane to the merits of the case. He was raising hue and cry in the Court to exert pressure on the Court to to get extended the ad-interim relief which was not in existence. It is not out context to mention that the advocate for the plaintiff has a habit to play to the gallery.  The conduct of the ld. advocate for the plaintiff dehors of the professional ethics and did not befit to the senior advocate like him. This court hopes that the ld. advocate for the  plaintiff  would maintain the decorum of the Court and avoid repeating such type of incidents in future.

Ld. Adv. for third party applicant points out that the plaintiff has filed an Appeal from order before Hon\''ble High Court bearing stamp no.6454/21 on 12.03.2021 against order of this Court dated 03.03.2021 vacating the earlier order of status quo.  It is necessary to note that the fact of filing AO was not brought to the notice of this Court by plaintiff while passing the order dated 23.12.2021.  As the order passed by this Court on 03.03.2021 is under challenge before Hon\''ble High Court, there is no reason for this Court to interfere with that order.

Ld. Adv. for plaintiff submits that there was some oversight and misunderstanding.  However, the webpage print out of the  appeal from order shows that Ld. Adv. for plaintiff representing in this Court has only filed appeal from order before Hon\''ble High Court.    Therefore, the order of extension of status quo dated 23.12.2021 is sought by plaintiff in suppression of the fact that appeal from order is pending before Hon\''ble High Court.  Hence, it stands vacated.  Plaintiff may file reply to the Ch/sum.
