The transfer is sought on the ground that the Presiding Officer in C.R.No.11 have fully heard Notice of Motion No.1609/2018 and had kept it for order, in the meantime, the Presiding Officer is transferred to C.R.No.1. Ld. Counsel prays to transfer L.C. Suit No.90/2009 from C.R.No.11 to C.R.No.1.
Ld. Counsel for the respondent strongly opposed the same. I have considered the submissions.
At the outset C.R.No.11 is a Special Court for the trial of BMC matters while C.R.No.1 is a Special Court for suits between private parties. For the purpose of deciding Notice of Motion, the BMC matter cannot be transferred to C.R.No.1 wherein the trial between private parties are held. In such circumstances, I am not inclined to transfer the matter and as such it stands rejected.
