with officer Shri Shakil Ahmed (Colony officer). Officer of
the corporation submitted that in L.C. Suit no. 2038/10,
2039/10, 2045/10, this court directed the MMC to follow
the procedure laid down in Sopan Maruti Thopate v/s Pune
Municipal corporation. The subject matter in the above suits
and the present suit is the same. Therefore, the defendant
corporation shall follow the direction of the court.
Accordingly, the notice and order in the present suit become
infractuous. In view of the statement of the officer now the
cause of action to the present suit does not survive.
Defendant corporation is directed to follow the law laid
down in Sopan Maruti Thopate v/s Pune Municipal
corporation AIR. 1996 Bom 304. There is ad interim order
in this suit. The same shall continue till passing of the order
and in case of adverse order two weeks thereafter. Suit and
NM No.3128/17 and 2169/18 are disposed of. Proceeding is
closed.
