Cross-examination of defendant witness Lalmani Ramlakhan Yadav
on oath by Adv. Balbheem Patil for plaintiff.
Defendant counsel Adv. Sandeep Dhuri is present.
17. In the year 2017 I was staying at Vikhroli and Diva. The
documents which I have mentioned in para No.2 of my evidence
affidavit, I say that I have handed over this documents to plaintiff at

Diva. Plaintiff never informed me that he is a bank employee prior to
receiving any documents from me. I say that only because I know
plaintiff and he used to visit my office so I have handed over
documents to him. It is not true that on 14.06.2017 I have borrowed
a loan of Rs.5,00,000/- from plaintiff. It is not true that plaintiff also
sent me a demand notice because I made a default in repayment.
18. Question: Plaintiff sued you in the year 2017 and how it is so
that you made a complaint (Exh.29) in September, 2021?
Answer: Plaintiff was assuring me that he will return my
documents so I have not filed a complaint earlier.
(Witness is shown service affidavit Exh.5 dated 26.09.2018 and
A.D. Card attached therewith). A.D. Card which is now shown to me
bears my signature. As witness admitted his signature on A.D. Card, it
is marked as Exh.30. It is not true that plaintiff never assured me to
give any documents and never met him in this regard. It is not true
that to support my false defense I have filed a false complaint in
2021.
