ORDER
1) The application is filed by plaintiff to stay the order
dt. 18.03.2021 for eight weeks to enable plaintiff to
challenge it before Hon'ble High Court.
2) The defendant filed reply and objected that the
plaintiff is enjoying the order of adinterim since last two
years and it is held that the structure is unauthorized. It is
further stated that eight weeks period is inordinate.
3) Heard adv. Mr. Pande for plaintiff and Adv. Roop
Basu for defendant. The notice of motion is decided on
18.03.2021. It is rejected on the ground that the plaintiff
failed to prove that he is occupant as per section 2 (17) of
MRTP Act. The documents on record filed by defendant
shows that the structure for which the plaintiff is seeking
protection are unauthorized structures. The order is signed
and uploaded. Considering the reasons of the order it will
not be proper on my part to grant any stay to the plaintiff.
Hence application is rejected.
