ORDER passed below CS:-
1) plaintiff has taken out CS for taking on the record legal
representatives of deceased defendant no. 02 Satyavati. It
is contended that said person expired on 11/10/2009. Adv
of defendant No. 4 submitted no reply. On behalf of
MCGM Chamber summons is strongly opposed. Heard
argument of the both the sides. Perused application along
with affidavit. Record shows that right to sue survives
after death of said lady. I find no reason to reject the
application. the application is having merits. Hence in the
interest of justice CS no. 1251/19 stands allowed as
prayed for. Plaintiff is permitted to carry out said
amendment/changes in the plaint as early as possible,
within 14 days. Said CS stands disposed off.
Matter adjourned 23/02/2021 for compliance.
