Official Liquidator for the plaintiff company has taken out this motion for condonation of delay of 520 days in filing the chamber summons. Official Liquidator of the plaintiff company had issued writ of summons to the defendants. The writ of summons is returned with the remark defendant No.2 is expired. After that applicant that is official liquidator had taken out steps to know the legal heirs of the deceased defendant No.2 and therefore, delay has been caused in filing the chamber summons. 2. Heard learned advocate Shri.Vedchetan Patil for the applicant -- 1 of 3 -- NM 2159/2018 SUIT NO.9551/89 2 that is official liquidator for the plaintiff company. The reasons assigned by the plaintiff for condonation of delay are found to be ‘sufficient cause’ as since applicant come to know that defendant No.2 is expired, he had taken steps to find the legal heir of deceased defendant No.2. 3.
