Heard Ld. counsel for plaintiff on Ex-2 an application for stay of suit.
She has relied upon the copy of order passed by National Company Law Tribunal, Mumbai Bench dated 10.01.2020.
It is submitted that as per provisions of section 14(4) r/w section 12 and section 85 of the insolvency and bankruptcy of 2016, the effect of Moratorium is that no suit can be instituted or no pending suit can be proceeded in respect of matter, which is seized by the adjudicating authority(i.e. NCLT) and it has the effect of staying the proceeding in the suit pending before the Civil Court by implication.
After going through the above said provisions, I am satisfied that this court cannot proceed with this suit, as per the order passed by NCLT, Mumbai dated 10.01.2020. Hence, the suit is required to be stayed.
In view of the above, the application at Ex-2 filed by the Ld. counsel for plaintiff is allowed and the proceedings in the suit are stayed.
