Order below Exh.1
Both parties and their counsels are present. They submitted that the
matter is settled between the parties and filed consent terms at
Exh.9 on record. Heard both parties. Both parties have admitted
contains and their signatures in the consent terms in Exh.9. The
plaintiff has submitted he has accepted an amount of Rs.
15,00,000/- towards full and final settlement. It is further
submitted that consent decree may be passed. Hence, considering
the facts and circumstances of the case, it is necessary to dispose of
the suit as settled. Hence, I proceed to pass following order.
Order
1. Sum. Suit No. 1117/2017 is disposed off as settled in view of
consent terms at Exh.9.
2. Pending summons for judgment no. 199/2019 is accordingly
disposed off.
3. Consent decree may be drawn in view of consent terms at Exh.9.
4. Consent terms at Exh.9 shall form part of consent decree.
5. The plaintiff may be entitled for refund of court fees, if any,
provided for in rules.
