O R D E R
This chamber summons is taken out by the plaintiff for
making amendment in the plaint as well as in the notice of motion. The
defendant corporation resisted this chamber summons by filing its reply.
Read the present chamber summons of the plaintiff, affidavit of the
plaintiff in support of the chamber summons and reply of the
defendant. Heard both the learned counsels on behalf of both the sides
at length. Perused the record.
2. After hearing the argument advanced of the both the sides
at length and scrutiny of the proposed amendment and reply of the
defendant corporation thereon, it appears to me that the present suit

came to be filed in the month of June, 2018. The defendant corporation
has passed the speaking order in the month of July, 2018 i.e. after filing
the present suit. Therefore the plaintiff want to make the proposed
amendment. If the proposed amendment is to be allowed, then nature
of the suit will be not the change, moreover, it will not surprise to the
defendant corporation. Therefore, I inclined to allowed present
chamber summons taken out of the plaintiff. Hence, I have proceed to
pass following order.
ORDER
1. The plaintiff Chamber summons No.1223/19 for making
amendment in the plaint and NM is hereby allowed as prayed for.
2. The plaintiff and his advocate are hereby directed to carry out
proposed amendment within stipulated period.
3. Chamber summons No. 1223/19 is disposed off accordingly.
