Cross Examination of Defendant’s witness No.2 Gagnjot Siingh
on oath by Adv. Arvind Giriraj (on VC) for plaintiff.
In the present of Adv. Sanjay Bhojwani for defendants on VC.
3. I don’t know Mr. Ashwin Lodha. Witness says my director know
him. Mr. Deepak Bathija who is partner of Maruti Steel Fab knows Mr.
Ashwin Lodha. I am associated with defendant since 2014. I was
associated with defendant in connection with VP operations. I know
Mr. Deepak Bathija since 2014. Defendant used two email address for
their official communication 1) siingh@marutisteelfab.com, 2)
deepak@marutisteelfab.com.
4. I used email ID siingh@marutisteelfab.com on behalf of
defendants. Second email ID deepak@ marutisteelfab.com was used
by Mr. Deepak Bathija. Witness is shown Exh.72 and 73. I do not
have any communication with plaintiff prior to 28.06.2016. I never
had personal interaction with plaintiff.
Question: what is the difference between nature of your work and
work of Mr Deepak Bathija?
Answer: Mr. Deepak is the partner of defendant and I am working in
that Company.
5. It is correct to say that I have addressed email as per
instruction of Mr. Deepak Bathija. I was interacting with Mr. Deepak
Shrivastav from Topworth i.e Company of Mr. Ashwin Lodha. Witness
again says that I was not interacting with anyone in Topworth.
Question: Can you provide a reason why you did not clarify with
anybody from Topworth in respect of subject invoice if according to
you there was a discrepancy in the same?
Answer: I have already clarified with Mr. Ashwin Lodha through

email sent on 28.06.2016 and 01.07.2016.
There was no reply from Mr. Ashwin Lodha about clarifying the
discrepancy. It is not true I am deposing false.
Cross examination is completed.
