O R D E R
This Chamber summons is taken out by the plaintiff for
making amendment in the suit as well as in the notice of motion. The
defendant/MMC have given reply on the same chamber summons.
Heard both the Ld. counsels on behalf of both the sides at length. Read
the present chamber summons and reply thereon. Perused the record.
2. The Ld. advocate on behalf of the plaintiff has argued that
the plaintiff wants to add schedule I annexed to the chamber summons
in the plaint. The defendants have resisted this chamber summons.
3. On careful perusal of the proposed amendment which

specifically mentioned in this chamber summons as schedule, on
scrutiny of the proposed amendment, I am of the opinion that if the
proposed amendment is to be allowed it will not change the nature of
the suit of the plaintiff. It will not cause any hardship on the other side.
Moreover, it was help to determine real controversy between the
parties. Therefore, I am inclined to pass following order.
ORDER
1. Chamber Summons No.1217/19 is hereby allowed as prayed for.
2. Plaintiff and his advocate are hereby directed to carry out proposed
amendment within stipulated period.
3. Chamber Summons No.1217/19 is disposed of accordingly.
