Both parties filed consent terms. TOR and marked as Exh-5.
Order below Exh.01
Both parties their counsel are present. They have filed
consent terms on record at Exh-05. Parties are verified with
terms and conditions in consent terms at Exh-05. They have
admitted and agreed the contents in the consent terms at
Exh-05. It is read and recorded. It appears plaintiff and
defendants have voluntarily agreed to settle the matter.
Further, it appears that, plaintiff has agreed and accepted an
amount of Rs.7,00,000/- towards full and final settlement.
Defendant had issued Seven cheque of rupees One lakh
each. It is further agreed between the parties after realization
of said cheque claim of plaintiff stands fully satisfied. If
defendant fails commits default in payment of installment,
plaintiff will be entitle to execute the decree for balance
amount. As matter is settled between the parties. Therefore,
it is necessary to dispose of the suit in view consent term at
Exh.05. Hence, I proceed to pass following order:-
Order
1. Summary suit No. 923 of 2017 is disposed off as settled
in view of consent terms at Exh-05.
2. The consent terms at Exh.05 shall form part and parcel
of decree.
3. Plaintiff is entitled for refund of court fee, if provided
for in rules.
4. Pending summons for judgment No.165/2018 is
disposed off accordingly.
5. Decree be drawn up accordingly.
