ORAL ORDER
1. This is an application filed by defendant to set aside order
discarding evidence of defendant No.1 and reopening evidence of
defendant No.1 for crossexamination of witness of defendant No.1.
2. Defendant has contended that witness did not deliberately
remained absent. It is stated that due to illhealth witness was unable to
present and he was advised bed rest by his doctor. It appears,
photocopy of Medical Certificate is also produced. Plaintiff has not filed
any say. It appears from photocopy of the Medical certificate produced
witness may be ill. Due to all these circumstances, it appears witness
has not been remained absent intentionally. Therefore, to give

opportunities to parties to fight case on merits, it will be proper to allow
Notice of Motion. Hence, following order :
ORDER
Notice of Motion No.2454 of 2019 is allowed.
