delay is of 7 years and 305 days. Ld. Counsel for applicant
submits that the appeal could not be filed as writ petition
and thereafter review petition was pending before
Hon&amp#039ble High Court and
Hon&amp#039ble Court, while rejecting the review
petition has granted liberty to the applicant to take
appropriate proceeding. Thereafter, the applicant was not in
India for some days and therefore, he could not file the
appeal. Ld. Counsel further states that the appellant is
similarly situated with with the appellants in the bunch of
appeals which have been admitted for hearing by this
Court. I perused the orders in Review Petition No.29/17 in
Writ Petition 1457/2010 and Writ Petition No.1536/18. For
the aforesaid reasons, I condone the delay, however, subject
to cost of Rs.5,000/- to DLSA. Appeal be registered. Adjd.
to 12/09/2018 for R and P. Disposed off on 13/07/2018
