1. Perused affidavit of service Exh.3. It is mentioned therein
that writ of summons alongwith true copy of the plaint are dispatched
and posted on 10.10.2019 by speed post with A.D. to defendant Nos.1,
2 and 3. It is further mentioned therein that defendant No.1 and 2 are
received sealed packets of writ of summons alongwith true copy of the
plaint on 05.11.2019 and 15.10.2019 respectively. It is mentioned

therein that the sealed envelope of writ of summons and copy of the
plaint is returned from the defendant No,3 with remark “unclaimed”.
2. Perused RPAD acknowledgement address to defendant
No.1 and 2. Those are at Exh.4 and 5. Perused postal envelope Exh.6
there is endorsement unclaimed and returned sender. It is addressed to
defendant No.3. Therefore, there is valid service of writ of summons to
defendant No.1, 2 and 3. They remained absent. Hence following
order:
