O R D E R
This chamber summons is taken out by the plaintiff for
making amendment in the plaint and notice of motion. This chamber
summons is resisted on behalf of the defendant no.1/MMC. Read the
present chamber summons and reply on behalf of defendant no.1
thereon. Heard both the learned counsels on behalf of both the sides .

2. The learned counsel on behalf of the plaintiff has submitted
that to add in the cause title of the plaint and in the notice of motion
and vakalatnama as defendant no.2 through the Asstt. Municipal
Commissioner, BMC, M/East Ward, having office at M/East Ward office
Bldg. Govandi, Mumbai 4500043, which is mentioned in the schedule in
affidavit in support of chamber summons.
3. On scrutiny of the chamber summons and perusal of the
plaintiff, it appears that if this proposed amendmend by way of chamber
summons is to be allowed, then it will not change the nature of the suit
or nature of the notice of motion. Moreover, it will not cause any
hardship on the part of defendants. Therefore, I am inclined to pass
following order.
ORDER
1. Chamber Summons No.1178/19 is hereby allowed as prayed for.
2. The plaintiffs and their advocate are hereby directed to carry out
proposed amendment in the plaint as well as in the notice of motion
within stipulated period.
3. Chamber Summons No.1178/19 is disposed off accordingly.
