Following order is passed on chs/ No. 437/2024.
ORDER
1. The plaintiff has taken out this ch/s for taking on record additional document and carry out amendment. It is stated that plaintiff has filed suit to challenge notice u/s 351 of MMC Act, issued by defendant/BMC and prayed for ad-interim injunction. The suit was filed in hurry during vacation and therefore whatever documents available with the plaintiff was handed over the Advocate. After filing suit due to Covid restriction plaintiff was not able to travel anywhere. It is further stated that his uncle was looking after business and now he had been to his native place. In the month of Dec -2023, the plaintiff has visited uncle’s place and at that time his uncle handed over the old document relating to suit structure. Therefore the plaintiff seeking permission to add said documents and permission to amend the plaint.
2. Deft/BMC strongly opposed ch/s. It is contended that it is delay tactics of the plaintiff in suit which is filed in 2018. There is no sufficient reason given for not filing documents at the time of filing the suit. The documents are not in respect of notice structure. The application is barred by law of limitations and amendment is not relating to subsequent event.
3. The deft No. 3 gave no objection to bring on record said documents.

5. The plaintiff has taken out present ch/s for amendment in the plaint under order 6 Rule 17 of Civil Procedure Code and to add the documents. The plaintiff sought amendment in the plaint as per annexure but there is no annexure to the ch/s. The plaintiff filed an application below Exh. 6 and prayed that at the time of taking out ch/s annexure was remain to be annexed and therefore requested to take on record annexure.
6. Further the plaintiff sought permission to add documents i.e. permission for water connection and notice by Superintendent of BMC in the name of Barkhullah Khan and true copy of application for census of the structure and census certificate issued by Controller of Slum. The documents are relevant for decision of suit. The suit is at pre-trial stage. It is settled principal that Court should be liberal while considering the amendment in the pleading at pre–trial stage. The proposed amendment appears to be just and necessary for complete and effective adjudication of dispute. There is no likely to change nature of suit and no prejudice would cause to other side. Hence ch/s deserves to be allowed. Hence I pass following order.
