Juvekar for defendant no. 1 present. Plaintiff and defendant in person present. Both parties and their advocate are present and filed consent terms at Exhibit-26. All of them admit its contents and they have singed thereupon voluntarily. They also admit that they are heirs of late Shri. Anant Krishnaji Dhuri and Late Smt. Kashibai Anant Dhuri. Both parties admit that all of them will sale the suit property within six month as per consent terms exhibit-25. They also state that plaintiffs, defendant no. 2 to 5 will have equal share over the sale proceeds. Plaintiffs, defendant no. 2 to 4 and heirs of defendant no. 5, who are arrayed as defendant no. 5(a) to (c) also admit that defendant no. 5a to 5c will succeed and entitled to share of defendant no. 5. Plaintiffs, defendant no. 2 to 4 and defendant no. 5(a) to (c) also admit that vide this consent terms they are bound to pay Rs. 45,00,000/- to the defendant no. 1 against his share and interest over the suit property after it is sold. Accordingly consent terms at Exhibit-26 are taken on record. The decree be drawn up in terms of consent term Exhibit-26. Court fees be refunded as per rules. As both parties have filed consent terms and at the request of both parties aforesaid observation are made. Therefore it is necessary to obtain the signature of each party below this order. Therefore all parties are directed to sign herein below. Accordingly suit no. 2361 of 2019 stands disposed of. In view of disposal of the suit Notice of motion 416/2024 stands disposed of.
