1. Prayer clause (a) and (b) of NM NOS.1029/2020 and NM NOS.2492/2020 is rejected.

              At this stage, the advocate for the plaintiff filed application and prayed that the operation and effect of order passed above be stayed for six weeks and the protection given to the plaintiff be extended for the above said period as plaintiff wants to challenge this order before Honble High Court. If the protection is not given to the plaintiff he will suffer irreparable loss.
             The advocate for the defendant / MCGM opposed the application on a ground that Suit building is dilapidated in condition. Both NM decided on merits. Therefore, prayed for rejection of application.
            It is a matter of record that today both NM decided on merits, but there is a Earlier protection given to the plaintiff. Plaintiff wants to challenge the order before Honble High Court, therefore in my opinion till challenging the order protection needs to be given to the plaintiff.
