Perused roznama. Both parties are absent. plaintiff had taken
out Summons for judgment No.258/19 on 04.11.2019. The
Summons for judgment was pending for hearing since
02.03.2021. Plaintiff has not pressed said Summons for
judgmen on 25.07.2022. Thereafter, he has taken out
Summons for judgment No.210/22 on 25.07.2022.
Defendant filed reply to Summons for judgment on
03.08.2022. Plaintiff filed rejoinder to reply to Summons for
judgment on 12.04.2023 and matter was adjourned for
hearing on 11.07.2023. The matter is pending for hearing on
Summons for judgment since 11.07.2023 till today. The
plaintiff was given ample opportunity to file original
documents and hearing Summons for judgment. As plaintiff
failed to file original documents, matter was adjourned to
dismissal order on 15.06.2024. On that day, plaintiff filed an
application for removal of caption dismissal with submission
that he will file original documents on next date. However,
till today, plaintiff has failed to file original documents and
hearing on Summons for judgment. It appears that plaintiff is
not interested in conducting the matter. Therefore, no
purpose would served by keeping the matter pending. Hence,
I proceed to pass following order:-
Order
1. Sum. Suit No.697 of 2019 is dismissed in default for
want of prosecution.
2. Pending summons for judgment No.210/2022 is
disposed of, as suit is dismissed in default.
