The following Order is passed on Contempt NM No. 4039/2018 after hearing both the parties:
                                      -: O R D E R :-
01.     By this Contempt NM, the defendant/MCGM contended that as the plaintiff is guilty of disobeying the Order of dtd. 24.05.2018, his properties are liable to be attached and he should be sentenced to suffer civil imprisonment. In this way, in view of the suit reliefs, this Contempt NM can’t be ‘tried together’ with the suit, as per the ratio laid in the matter of Rampyaribai Sukhdeo Daga Vs. Niladevo Narayandas Jakhotiya, 2007 (4) Mh.L.J. 213. Surely, it may require conduction of the inquiry, wherein the defendant may also choose to lead evidence in support of its contentions. Further, the standard of proof needed to prove the contempt is that of beyond reasonable doubt. Therefore, it wouldn’t be appropriate to try and decide this Contempt NM, along-with the suit, as it would hamper its progress. Hence, without recording finding on its merits, Contempt NM No. 4039/2018 is disposed of as not triable, along-with this suit. The defendant is still placed at liberty to prefer separate Miscellaneous Judicial Case about the said Contempt, if it so desires.
