Heard ld. Advocate Shri Shashidhar for plaintiff in chamber
summons wherein it is requested for addition of prayer to condone the
delay in Notice of Motion No. 883/2019.

2. It is strongly resisted by ld. Advocate Rajgor for defendant
Mukund Limited who had preferred counter claim against the plaintiff.
3. Perused details mentioned in Notice of Motion No.
883/2019. This is a suit received by way of transfer from the Hon'ble
High Court. It appears to be inadvertent error. Various points as
argued by ld. Advocate Rajgor can be considered in Notice of Motion
No. 883/2019. It appears to be formal amendment, which will not
change the nature of material pleadings in Notice of Motion No.
883/2019. Hence chamber summons deserves to be allowed. Hence
the order :
ORDER
1. Chamber Summons No. 1147/2019 is allowed.
2. Plaintiff is at liberty to carry on amendment in Notice of
Motion No. 883/2019 on or before next date.
3. Ch/s No. 1147/19 is disposed of accordingly.
