Further Examination in chief of plaintiff witness Shelton
Coutinho on oath by Adv. Dipesh Palvankar, for plaintiff.
Defendant side called, but absent.
1) Affidavit now shown to me bears my signature. Its
contents are true and correct. It is already marked as Exh.14.
2) Through List of Documents at Exh.15, I have filed
following documents :
Exh.17 : Original PAAA document dt. 20.12.2013 shown to
me is the same. It was executed between me, my
father Leo Coutinho and defendant Rockford
Structures through director Mr. Jitendra Shah. It
bears my signature and signatures of my father and
director Mr. Shah. My father and Mr. Shah signed it
before me. We all three also put our thumb
impressions on the said agreement at page 17.
Contents therein are true and correct. It also bears
signature of two witnesses. Thereafter the said
agreement was present before Sub-Registrar,
Mumbai 1 for registration through myself and Mr.
Malayanch Shirishbhai Batavia as a power of
attorney holder Mr. Jitendra Shah. It is marked as
Exh.17.
Exh.18 : Original cheque dt. 03.10.2014 drawn by defendant
to the plaintif for sum of Rs.1,90,000/-. It is marked
as Exh.18.
Article.A : Photocopy of Central Bank of India statement dt.
28.10.2014. It is marked as Article A.
Article.B : Copy of electricity bill for 18.12.2024. It is marked
as Article B.
Article.C Photocopy of reminder notice dt. 19.10.2015. It is
marked as Article C.
Article.D Copy of legal notice dt. 08.08.2016. It is marked as
Article D.

Article.E Photocopy of Order dt. 15.10.2018. It is marked as
Article E.
Article.F Photocopy of application filed under RTI to State
Public Information Officer with acknowledgment
and information received from Information Officer
(in all 3 letters) through RTI in response to my RTI
application. Photocopy bears my signature. Contents
therein are true and correct. Photocopy of
application alongwith 3 letter collectively marked as
Article F. I have filed office copy alongwith
acknowledgment of application filed under RTI Act
and today while deposing in Suit No. 100759 / 2021
before this Court the said document alongwith 3
letters received by me under RTI Act are exhibited.
After obtaining certified copy I will file it on record.
Court observation : It is made clear to both parties that,
documents are marked as Exhibit (in accordance with contents
from evidence affidavit) for identification purpose.
Both sides are at liberty to prove and disprove the contents of the
documents, in accordance with various provisions, pertaining to
Commercial Courts Act, Code of Civil Procedure, Indian
Evidence Act and Information Technology Act.

In the interest of justice Suit adjourned for cross-examination.
