     Perused the Chamber Summons and say of the plaintiff. Heard both sides. By way of this CS the defendant Nos. 6 to 8 are seeking permission to amend their Written Statement as per the schedule 1 and also to dispose of NM No. 4986/2015, CS No. 1978/2016 and the CS No. 1105/2018. It is submitted that plaintiff and defendants are belonging to same family. It is submitted that the defendant Nos. 6 to 8 have already filed Written Statement on record. Now they want to claim certain reliefs by paying Court fees and also requesting to the Court to convert their Written Statement in to the counter claim to that extend they are seeking permission to amend their Written Statement.
     The plaintiff has formally objected the CS. The defendant Nos. 6 to 8 want to claim their share as per Exhibit G to the plaint. For that purpose they want to amend their Written Statement by incorporating necessary reliefs and convert their Written Statement in to the counter claim. It is not disputed that the plaintiff and defendant Nos. 6 to 8 are having their respective shares in the properties of the firm “ M/s. Raghunath Ramchandra Samant and brothers”. The defendants are ready to pay necessary Court fees. As the plaintiff and defendant Nos. 6 to 8 are siblings and they can claim their respective shares in the aforesaid properties of the firm.
     Considering the facts and circumstances of the case, it is necessary to partly allow the Chamber Summons in respect of prayer clause (a). So far as the relief claim in prayer clause (b) is concerned The NM 4986/2015 and NM No. 456/21 are tagged with the suit and will be decided alongwith the main suit vide order dtd. 03.11.2022. The record further indicates that the CS No. 1986/16 and 1105 of 2018 were disposed of vide order dtd. 03.11.2022 and 11.07.2019 respectively. In view of the same, the NM No. 4986/15 can not be disposed of at this stage. In the result following order is passed :
ORDER :
1. The Chamber Summons. No. 1144 of 2019 is hereby allowed in terms of prayer clause (a).
2. The defendant Nos. 6 to 8 are permitted to carry out the amendment as per schedule (I) within stipulated period in their Written Statement.
3. The copy of amended Written Statement be supplied to other side.
4. The defendant Nos. 6 to 8 are directed to pay requisite Court fees after carrying out the amendment.
5. The amended Written Statement of defendant Nos. 6 to 8 be converted in to the Counter claim.
6. The  Chamber Summons. No.1144 of 2019 is disposed of accordingly.
