Cross-examination of plaintiff witness Ghisulal Jain on oath by
Advocate Mangesh Sawant , for defendant Nos.1, 3 and 4.
None present for defendant No.2.
Plaintiff counsel Meenakshi Gala present.
1) I know defendant No.1 only by way of Market
Acquaintance. The owner of Silver Arch had approached me for
money. No other person was involved in said Money transaction.
Witness volunteers that, his son Mukesh Kumar was involved in
the transaction. I had myself advanced the money to the
defendant. Defendant did not approach me for money. I had levied
rate of interest as 12 % considering the reputation of defendant in
the Market. By Market, I mean Zaveri Market. Whether the
defendant had requested amount to me, on that, I say that, in the
market, many person used to provide money to the defendant and
hence, I also provided money on my own to the defendant. True
to say that, in para No.3 of my plaint, I have stated that, the
defendant had approached me for money. While advancing the
money, I had not asked for any security. I had not asked for any
identification. I have no knowledge whether Money lending
licenses is required for advancing money. Not true to say that, I
am deposing false.
Cross-examination is Over. Re-examination : Declined
Defendant No.2 called, but absent. No application by defendant
No.2 for adjournment. Hence, suit to proceed without cross-
examination at the hands of defendant No.2.
