ORAL ORDER
This is a notice of motion taken out by defendant for
condonation delay of 82 days and to accept Written Statement.
2. Heard learned advocate Mr.Shirke for defendant at
sufficient length.
3. Perused reply filed by plaintiff. Heard learned advocate
Miss. Thakkar for plaintiff, it is strongly resisted. It is requested to
reject the motion, in the alternative claimed for heavy cost.
4. On perusal of grounds mentioned in affidavit submitted on
behalf of plaintiff, some necessary permission require to obtain from

legal department of the defendant Bank. It is always appropriate to
decide the matter on merit. Hence written statement be accepted
subject to cost of Rs. 4,000/. Hence the order.
ORDER
1. Notice of Motion No.2292 of 2019 is allowed.
2. Delay of 82 days is condone.
3. Defendant to pay the cost of Rs.4,000/ (Rs. Four Thousand) to
plaintiff on or before next date.
4. Advance copy of written statement be accepted, copy is served to
plaintiff.
3. The Notice of Motion No. 2292 of 2019 is disposed of
accordingly.
