The advocate for plaintiff submitted that during pendency of
the suit by way of abundant precaution the plaintiff no. 1
filed an application for regularization of addition, alteration
or various premises being subject matter of the suit.
Therefore, he is ready to withdraw the suit. It is further
submitted that the earlier order passed in favour of the
plaintiff be continued till the decision on regularization
application. He further submitted that in case the said order
is passed against the plaintiff then interim protection be
extended for next four weeks from the date of
communication of the order. Adv. Mr. Giri for BMC
present. Officer Mr. Swapnil Sanap, Junior Engineer
present. The advocate for the corporation consented for
disposal of suit and extending the interim relief till the
decision of application filed for regularization. However, he
objected for extension of interim relief for four weeks after
communication of the order. Considering the submissions
made since the plaintiff already filed an application for
regularization no purpose will be served by keeping the suit
pending. Therefore, the suit stands disposed of. The interim
protection granted in favour of plaintiff be continued till
decision of the application filed by plaintiff for
regularization. The Municipal corporation is hereby directed
to decide application for regularization within four weeks.
In case the application filed by plaintiff is rejected and
adverse order is passed then ad-interim relief be extended
for the period of three weeks to enable to plaintiff to
challenge the said order before appropriate forum. The Suit
be registered for statistical purpose. As suit is disposed off
hence, Ch/sum no. 887/18 and N/M no. 2059/18 is stand
disposed off.
