ORDER
1. Heard advocate for the plaintiff and advocate for defendants.
Plaintiff by this Chamber Summons seeks to add the legal heirs of
deceased Vijay Baburao Pingle who died on 15.09.2014. Admittedly
the Chamber Summons is filed on 22.03.2018. It is contended by the
defendant that the suit is abated.
2. Plaintiff had prayed for 1/5th share in the new flat. Considering

the nature of the suit it is for partition. The interested parties to the suit
are required to be before the Court for effective adjudication. In the
interest of justice the abatement is set aside. Plaintiff need to be
permitted to bring the Legal heirs of deceased defendant no. 9 on
record.
In the result, following order is passed.
ORDER
1. Chamber Summons No. 859 of 2018 is allowed.
2. The plaintiff is permitted to bring the legal heirs of defendant no. 9
on record.
3. The plaintiff to carry out the necessary amendment within 15 days.
4. Chamber Summons stands disposed off.
