&ampamp 10 Exh.8 is Consent Terms filed by the
plaintiff and defendant no.1 and 2. Defendant no.1 is the firm.
The plaintiff and defendant no.2 have settled their dispute by
paying amount of Rs.2,00,000/- to the plaintiff as mentioned in
para 2(b) of Exh.8. Similarly, Exh.10 is filed by the plaintiff
for deletion of names of defendants no.3(a) to 3(c) because
they had executed Relinquishment Deed dated 05/11/2016 and
their interest in the firm is over. Considering all these aspects, I
pass the following order : - ORDER - 1. Application (Exh.10)
is allowed. 2. Names of defendants no.3(a) to 3(c) are deleted
as per order on Exh.10. 3. Suit No. 4797/2012 is decreed in
terms of Consent Terms (Exh.8). 4. Parties shall bear their own
cost. 5. Court fees shall be refunded to the plaintiff as per rules
and refund certificate be issued accordingly. 6. Compromise
decree be drawn up accordingly. 7. Consent Terms (Exh.8)
shall form part and parcel of the Compromise Decree. 8.
Notice of Motion No. 2273/2019 and 2253/2019 are disposed
off having become infructuous due to disposal of the main
matter.
