1. Perused application Exh.4 and Order passed on it today.
Shri Nakul, Chief Manager of the plaintiff Bank is present. He is
identified by Advocate Anant B. Shinde. He has submitted that plaintiff
Bank has recovered the outstanding balance amount from the
defendants. As per Order passed Exh.4 plaintiff is permitted to

withdraw the suit under Order 23 Rule 1 of the CPC. Hence no purpose
will be served by keeping the matter pending. Therefore following
order:
ORDER
1. The Suit NO. 1734 of 2018 is disposed of as withdrawn
unconditionally under order 23 rule 1 of Code of Civil Procedure.
2. Court fee be refunded to the plaintiff as per rule.
