I have already heard respected advocates on 13/08/2018 on the point of granting ad-interim relief. Perused the copies of the documents filed by the respective parties and reply of the defendant.
The plaintiff seeks ad-interim injunction for restraining the defendants from disturbing possession of the plaintiff or dispossessing him from the pitch area ad-measuring 1x1 meter. According to plaintiff he is using that area since 1990 on footpath. He has paid penalty. The copy of letter dated 27/04/1992 prima facie shows that one MLA requested the then Minister for State- Home Affairs to allow the plaintiff to do his business near Cafe Colaba. The copies of receipts show that the plaintiff has paid penalty amount for doing the business unlawfully at the footpath. The copies of receipt show that he has applied for his registration as a street vendor. He has been informed that his eligibility would be verified and accordingly informed to him. The plaintiff has not placed on record to show that he is holding any license as a vendor and has been allotted some pitch by the defendant corporation for doing his business. He has also placed on record that his eligibility has been fixed by the defendant. He also filed copy of identity card of the Hawkers Union. He placed reliance on the ratio of the judgment and order dated 09/09/2013 passed by the Hon\''ble Supreme Court in the case of Maharashtra Ekta Hawkers Union V/s. MCGM.
Ld. Advocate for defendant submits that by following due process of law action has been initiated against the defendant. According to her the officer for the defendant inspected the site. The plaintiff was not doing any business. She relied on the photographs. The plaintiff is not an authorized/licensed hawkers.
The plaintiff has not placed anything on record to show that he is in use and occupation of the said pitch and doing his business on the footpath in front of Cafe Royal. Therefore, the apprehension expressed by the plaintiff, is not supported by any material except bare affirmation Therefore, the following order is passed-

ORDER
Vide order dated 16.08.2024 present suit is kept for dismissal order. However, almost last 4 to 5 years plaintiff and his counsel remained absent. The record further discloses that in view of order Dtd. 30.01.2023 matter is proceeded without W. S. against defendants even though plaintiff failed to adduce his evidence. Therefore, taking into consideration above facts, it appears that plaintiff is not interested to proceed with this suit, so obviously it is liable to be dismissed for want of prosecution. In the result, accordingly following order is passed -
1. Suit No. 1372 of 2018 is hereby dismissed in default for want of prosecution.
2. No order as to costs.
3. Bill of costs be drawn up accordingly.
