Oral Order:
The plaintiffs' notice of motion is for the limited
purpose seeking extension of time to deposit the amount of
Rs.10,000/ with the legal aid department. Perused. Heard
learned Counsel for the plaintiffs.
2. By order dated 3.4.2018 passed by this Court,
plaintiff was directed to deposit costs of Rs.10,000/ to the
legal aid department within 15 days. Plaint was ordered to be
returned to the plaintiffs within 15 days on deposit of costs to
present it before the Court of Small Causes. The plaintiffs
could not pay the costs within stipulated time as he received
certified copy of the order on 26.4.2018 by the time 15 days

time to deposit the costs elapsed. The plaintiffs are ready to
deposit the amount. The suit has already been withdrawn and
directed to be present it before the appropriate forum. The
prayer of the plaintiff is just which can be granted.
In the result, following order is passed :
ORDER
1. Notice of Motion no. 1874 of 2018 is allowed.
2. Time to deposit the costs of Rs.10,000/ with the legal aid
department is extended by 15 days.
3. No costs.
