The following Order is passed on Contempt NM No. 406/2022:

01.     By filing this Contempt NM, the plaintiff contended that the contemptners are guilty of contempt of the Court by issuing  notice dtd. 15.01.2022 and hence, they are to be sent to imprisonment for such breach. It is, thus, clear that in the light of the suit reliefs, this NM can not be ‘tried together’ with the suit in view of the ratio laid in Rampyaribai Sukhdeo Daga Vs. Niladevo Narayandas Jakhotiya, 2007 (4) Mh.L.J. 213. Certainly, it would require conduction of the inquiry, wherein the plaintiff may also choose to lead the evidence in support of their stands. However, it wouldn’t be appropriate to try and decide this Contempt NM along-with this suit, as it would hamper its very progress. Therefore, without recording any finding on its merits, the Contempt NM No.406/2022 is disposed of as 'not triable', along-with the suit. The plaintiffs are still placed at liberty to prefer separate Misc. Judicial Case about such Contempt, if they so desire.
