ORAL ORDER
This petition is under Section 58(3)of Juvenile Justice Act,
2015 for adoption of child by name BHAIRAV @ ACHYUTHA
S.KANGOVI
Petitioner's case is thus :
2. The WWTI, Bal Anand, are the custodian of a male minor
MALHAR whose date of birth is 22/6/2017 was transferred from
Observation Home to Bal Anand. The petitioner now intend to give this
child in adoption to the prospective adoptive parents (being co
petitioners as per provision 66 of the Juvenile Justice Act) (as
amended) Act. The petitioners are resident at Karnataka and registered
with C.A.R.A. with registration no.PrKa3002135 and were directed by
the C.A.R.A.to apply to WWTI BAL ANAND. Accordingly, petitioner and
copetitioner agreed to adopt the child. Accordingly, after compliance
of all the formalities, petitioner and copetitioners executed the Foster
Care Agreement on 2/5/2018 which is on record (Page no.39 to 40)
and thereby filed this petition.
3. In response to the petition, Scrutiny Officer,
Mr.O.Hareendran submitted his report at Exh2. Social Worker
Vandana Patil filed her affidavit at page no.17 dated 3/5/2018 marked
at ExhC. In support of their petition, Copetitioner Shashiprasad
Gopinath Kangovi and Champaka Sathyanarayana Rao filed affidavit of
evidence at Exh3 & 4 respectively. They are married on 09/05/2004

and having no issue from their Wedlok and desirous to take the child
into adoption. By filing affidavits, petitioner as well as proposed
petitioner/copetitioner filed their evidence on affidavit which is found
to be cogent and reliable. On verification, they admitted the contents
and agreed to confirm the adoption of male child by name Bhairav @
Achyutha.
4. Heard the petitioner as well as Advocate Sameer Sawant
and Scrutiny Officer. Perused the documents filed on record in respect
of age, income, birth date, residence, marriage, Marriage Certificate of
the Petitioner, report of the Scrutiny Officer as well as Child Study
Report, Home Study Report, undertaking etc. They are taken on record.
5. Upon perusal of the record as well as upon hearing, it
reveals that child is given in the custody of proposed adoptive parents
and residing happily with them. Proposed adoptive parents
Shashiprasad Gopinath Kangovi and Champaka Sathyanarayana Rao
shown their willingness to invest Rs.1,00,000/as one time premium in
LIC Policy in the name of child and to nominate the adoptive child
BHAIRAV @ ACHYUTHA S.KANGOVI in his property and the other LIC
Policy, if any.
6. Considering the prayer as well as the documents filed on
record, I am satisfied to grant the permission to adopt the child.
7. Hence, the order.
ORDER
Adoption Petition No.314 of 2018 is allowed as under:
1.Copetitioners/proposed adoptive parents permitted to
adopt the male minor child BHAIRAV @ ACHYUTHA as per

the Juvenile Justice (Care and Protection of Children) Act,
2015 from the petitioner WWTI Bal Anand, a registered
society having its registered address at Sai Krupa 93,
Ghatala Village, Chembur, Mumbai 400 071.
2. Copetitioners/proposed adoptive parents shall invest
Rs.1,00,000/ in the name of child BHAIRAV @
ACHYUTHA as one time premium in the LIC Policy and to
nominate the child in their property and other LIC policies,
if any, within three months from the date of this order.
3. Municipal Authorities shall issue Birth Certificate of child
namely BHAIRAV @ ACHYUTHA having date of birth as
22/6/2017.
4. The adoptive parents do pay a sum of Rs.2,500/ to the
Indian Council of Social Welfare, Mumbai towards the cost
of scrutiny and investigation.
5. Adoption Petition is hereby disposed off.
