This Review petition is with regard to order in chamber
summons dated 31st October, 2017. As per the order in chamber
summons, the plaintiff was directed to add one Rajesh Bhavsar as a
party defendant no.4 in the suit. The same order was passed in similar
11 cases.
2. By virtue of Writ petition no.13175/2017 one such similar

order was challenged and on 21st March, 2018 the Hon'ble High Court
has allowed the Writ petition and set aside the order passed in chamber
summons. It was mentioned in the said order that petitioner therein
has under taken to delete paragraph no.8(c) of the plaint. In the case in
hand the plaintiff has filed additional affidavit and has given
undertaking to take appropriate steps for deletion of the paragraph
no.8(c) of the plaint. The order passed in chamber summons was the
common order to all the suits. In view of the order passed in writ
petition no. 13175/17 and as the plaintiff has undertaken to delete
paragraph no.8(c), it becomes necessary to review the order passed in
chamber summons. Hence, I pass the following order.
ORDER
Review petition is allowed and made absolute in
terms of prayer clause (a)
Review petition is disposed of accordingly.
