Heard respective advocates.  Ld. Adv. Pande submits that the suit shop has been taken on rent by the plaintiff in 2017.  The previous tenant in 1985, has repaired the wooden mezzanine floor with the permission of defendant  corporation.  The plaintiff has not carried out any construction of mezzanine floor.  According to him the plaintiff has not received any notice.
  Adv. Dhumale submits that the first inspection report shows that the construction of mezzanine floor has been carried out by MS channel and ladi coba, ladi slab and a notice U/s 351 of MMC Act has already been issued to the owner/user/occupier/contractor.
  On going through the copy of notice, it has been issue to Mr. Shanti Jain relating to ground floor premises located at 392, Kalbadevi road, Mumbai.  The suit shop bears no. 1 and is located on the ground floor of the building no. 398/CD which according to plaintiff  belongs to Bombay Halai Bhatia Mahajan.  Prima facie there is nothing on record to show that both the properties at 392 and 398/CD are one and the same.  Under such circumstance intervention of this court appears necessary.  Thus the following order is passed -
The defendant is restrained from demolishing the mezzanine floor in the suit shop at the ground floor of building no. 398/CD till further orders.
  An ordinary copy of this order duly authenticated by the Sheristedar of this court be supplied to both the parties.
