Heard both sides on the marking of documents with list Exhibit-28 tendered by the defendant alongwith his affidavit in lieu of examination in chief (Exhibit-27).
The document at serial no. 1 is an office copy of a letter given by the defendant to the office of Corporation and endorsement of the Corporation is there on record. As such that letter is marked as Exhibit-29.
The document at serial no. 2, though referred in the examination in chief by the defendant, it is photocopy and not original. It is submitted on behalf of the defendant that original thereof might have been produced by him in a proceeding before the Labour Court. If so he may get back that original. As such photocopy of the letter, which is denied by the plaintiff cannot be read in evidence in absence of original thereof.
The document at serial no. 3, it is original Voter Identity Card of the defendant issued by the Election Commission of India. It is marked as Exhibit-30.
The document at serial no. 4 is original Aadhar card of the defendant. It is marked as Exhibit-31.
The document at serial no. 5 is the original driving license of the defendant. It is marked as Exhibit-32.
The document at serial no. 6 is a photocopy, which is not admissible.
The document at serial no. 7 is a certificate issued by the Tahsildar, Mumbai City. It is marked as Exhibit-33.
