The advocate for plaintiff opposed the Notice of Motion. Heard learned advocates of both the sides. The defendant submitted that, written statement is ready in all respect and could be filed today itself. In my opinion , justified reasons are shown for not filing the written statement within statutory period. For fair trial and proper adjudication of the case, the Notice of Motion no.1850 of 18 is allowed and made absolute in terms of prayer clause(a) subject to the conditions that today itself the defendant shall file the written statement on record.
