This is notice of motion to condone the delay of 152 days in filing the written statement. The defendant states that she has never received the summons of the suit. She states that she is widow living with her daughter. She states that she has sufficient reasons to condone the delay, the delay is not intentional . She states that she could not file her written statement because of her old age, ill health and her personal difficulties. She states that no loss will be caused to the plaintiff if the delay is condoned and her written statement is taken on record.
The plaintiff has not filed his reply on this notice of motion. I am of the view that the written statement of the defendant is necessary to decide the suit on merits. The delay in filing written statement is not intentional but due to the old age, ill health and getting correct legal opinion. If the defendant is directed to pay appropriate costs to the other side, it will meet the ends of justice. So, I condone the delay of 152 days by imposing costs of Rs.2000/- only to be paid to the other side and allow the notice of motion. Accordingly the order :
    1. The notice of motion No. 2089/2024 is hereby allowed.
    2. The defendant is hereby directed to pay costs of Rs.2000/- only to the plaintiffs within 14 days from the date of the order.
    3. The written statement will be taken on record only after payment of costs of Rs.2000/- as per the order.
