Pdf Text: By praecipe Advocate S.K.Dubey for plaintiff present and filed draft notice of
motion along with affidavit in support. T.O.R. Advocate Mr. Giri for
defendant/MCGM present. Heard. The plaintiff has come with the case that a notice
u/s 354A of MMC Act dated 12.06.2019 is received by the plaintiff on 14.06.2019.
He has replied the notice vide his reply dated 14.06.2019. According to the plaintiff
no speaking order is yet passed deciding his reply dated 14.06.2019. Advocate for
defendant Corporation submitted that he has no instructions as to whether the order
is passed or not. The advocate for plaintiff has no objection if the suit is disposed off
by granting protection to the plaintiff till passing of order by defendant Corporation
deciding plaintiff&amp#039s reply dated 14.06.2019 and two weeks thereafter
if the order passed by defendant Corporation is adverse to the plaintiff. Hence, the
order ORDER 1. Defendant corporation shall not act upon the notice dated
12.06.2019 issued u/s 354A in respect of the suit premises till passing of the
speaking order deciding plaintiff &amp#039s reply dated 14.06.2019 and two
weeks thereafter if the order passed by defendant Corporation is adverse to the
plaintiff. 2. With above direction the suit is disposed off. 3. Draft NM also stands
disposed off. It be registered for statistical purpose. 4. No order as to costs
Authenticated copy of order be given to the parties.
