O R D E R
1. Perused. Heard. Heard finally.
2. The plaintiff has sought to amend the plaint in order to bring the
event of passing of Order by defendant, to plead its nullity and to seek
relief for its declaration and injunction.
3. The Chamber Summons is opposed on the ground that the
amendment will change the nature of the suit.
4. Considering that the suit was filed on 17.6.2019 and the
Speaking Order is served on plaintiff on 18.6.2019, it being the
subsequent event can legitimately be brought on record. The nature of

suit will not be changed even after the amendment since the suit
will remain a suit for declaration and injunction. Hence the order:
ORDER
1. Draft Chamber Summons is made absolute in terms of prayer
Clause (a).
2. Plaintiff shall carry out the amendment within two weeks
from today.
4. The Plaintiff shall serve the copy of amended plaint on the
defendant and shall submit a typed copy of amended plaint
before this Court.
5. Draft Chamber Summons is disposed off. It be registered for
statistical purpose.
