The acceptance of WS was conditional i.e. depositing Rs. 2,000/- to DLSA, Mumbai. But from 03/03/2020 till date it is not shown by the Defendant that whether that order has been complied with or not. Therefore, the office to submit report that whether an amount of Rs. 2,000/- has been deposited as compliance of order in NM No. 1758/2019 dated 03/03/2020 or not. Office to submit report today itself.

Adv. Ms. Meena Pande for Defendant present. She informed that till date the Defendant has not deposited the amount of Rs. 2,000/- in DLSA. She made an application seeking leave to make deposit it today. Heard. Perused the record. The record goes to show that earlier the WS was not filed in time. Though it was accepted, for no just reason, the condition of depositing Rs. 2,000/- was not observed. Considering the conduct of Defendant, now there is no reason to grant further concession. But considering the nature of suit and the adjudication of rival questions of controversy in present suit itself to avoid the multiplicity of proceeding, now the DLSA office is asked to accept Rs. 2,000/- today, but for above reasons it should be subject to making payment of Rs. 5,000/- to Plaintiff as costs as due to conduct of Defendant, Plaintiff suffered.
Costs of Rs. 5,000/- paid today itself. DLSA to accept Rs. 2,000/- from Defendant.
